1. Agreement to Terms

By accessing or using the Elite Freight website (www.elitefreight.ma) and our freight forwarding services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

Elite Freight is an international freight forwarding company based in Casablanca, Morocco. We provide:

• Road freight services (FTL and LTL) from Morocco to Europe
• Sea freight services (LCL and FCL) to global destinations
• Air freight services for time-sensitive cargo
• Logistics and warehousing solutions
• Multimodal transport coordination

We act as a freight forwarding intermediary and coordinate with carriers, shipping lines, airlines, and other logistics providers to facilitate the transport of your goods.

3. Quotes and Pricing

• All quotes provided are estimates and subject to change based on actual cargo specifications, fuel surcharges, currency fluctuations, and carrier availability.
• Quotes are valid for the period specified in the quotation document, typically 14 days unless otherwise stated.
• Final pricing is confirmed upon booking and acceptance of the shipment order.
• Additional charges may apply for customs duties, taxes, demurrage, detention, storage, or other ancillary services.

4. Booking and Shipment

• A booking is confirmed once Elite Freight issues a written booking confirmation.
• The customer is responsible for providing accurate information about cargo dimensions, weight, value, and nature of goods.
• Dangerous goods, restricted items, and special cargo must be declared in advance and are subject to additional terms and approvals.
• Transit times are estimates and not guaranteed. Delays due to weather, port congestion, customs clearance, or force majeure events are outside our control.

5. Customer Responsibilities

As our customer, you agree to:

• Provide complete and accurate shipment information
• Ensure proper packaging and labeling of goods
• Obtain all necessary export/import licenses and permits
• Comply with all applicable laws, regulations, and trade sanctions
• Pay all invoices within the agreed payment terms
• Arrange adequate cargo insurance where applicable

6. Liability

• Elite Freight's liability as a freight forwarder is governed by the applicable international conventions and Moroccan transport law.
• We are not liable for loss, damage, or delay caused by force majeure, acts of war, terrorism, strikes, natural disasters, government actions, or circumstances beyond our reasonable control.
• Our liability is limited to the terms specified in our standard trading conditions and applicable law.
• We strongly recommend that customers obtain comprehensive cargo insurance for all shipments.

7. Insurance

Elite Freight can arrange cargo insurance upon request. Unless specifically requested and confirmed in writing, shipments are not insured by us. The customer bears the risk of loss or damage during transit unless insurance has been arranged.

8. Payment Terms

• Payment terms are specified on each invoice issued by Elite Freight.
• Late payments may incur interest charges as permitted by Moroccan law.
• Elite Freight reserves the right to withhold or exercise a lien on goods for unpaid invoices.

9. Intellectual Property

All content on the Elite Freight website, including text, graphics, logos, images, and software, is the property of Elite Freight and is protected by Moroccan and international intellectual property laws. You may not reproduce, distribute, or use our content without prior written consent.

10. Website Use

• You agree to use our website only for lawful purposes.
• You must not attempt to gain unauthorized access to our systems.
• Information submitted through our forms must be accurate and truthful.
• We reserve the right to modify or discontinue any part of the website without notice.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Casablanca.

12. Changes to Terms

We reserve the right to update these Terms of Service at any time. Continued use of our website or services after changes constitutes acceptance of the updated terms.
